Terms of Agreement

The Chocolate Pretzel Factory LCC. Is not at any fault if anyone does not fully read or understand these terms of agreement. You agree to comply with all applicable laws and regulations of the various states and of the United States. You agree and represent that you are buying only for your own internal use only, and not for resale or export. All products are produced in an environment that has become in contact with peanuts. 1. Orders, Payment Terms Payment terms are within The Chocolate Pretzel Factory LCC sole discretion. You agree not to violate the terms of any offer or concession made available by The Chocolate Pretzel Factory LCC. The Chocolate Pretzel Factory LCC may invoice or ship items of an order separately. The Chocolate Pretzel Factory LCC reserves the right to cancel an order or transaction, in whole or in part without notice. If you breach the provisions of this Agreement or the terms of any offer, The Chocolate Pretzel Factory LCC may charge or re-debit your account or credit card the full list price for your purchase. 2. Shipping Charges; Taxes. Shipping dates provided by The Chocolate Pretzel Factory LCC are estimates only. Shipping and handling are additional and will be shown on the invoice(s) or other documentation. Loss or damage that occurs during shipping by a carrier selected by The Chocolate Pretzel Factory LCC is The Chocolate Pretzel Factory LCC responsibility. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility. You will also be responsible for sales, goods, and services, and all other taxes and fees associated with the order.We use only the freshest ingredients in our gourmet products, so we also take extra special care in packaging and shipping them to you. This ensures that you receive the most perfect package possible. So we ship them as follows. If you have any questions about these policies, please contact Shipping@thechocolatepretzelfactory.com When We Ship Orders placed between Saturday and Friday are shipped the following Monday. We will only ship your package on a Monday to avoid any excess time in transit. Destinations Currently we only ship to the United States and are unable to ship to, the Virgin Islands, PO Boxes or APO & FPO locations. We hope to be able to send our gourmet products to these locations soon. Shipping to a Business Address If you are sending your package to a business or hotel, please be aware that the package may be delivered to a receiving department. Please let the recipient know to expect a perishable package. The Chocolate Pretzel Factory LLC is not responsible if the business is closed or if the carrier is unable to deliver the package. For these addresses, please include as much information as possible including company name, telephone and extension numbers, suite or hotel room number, recipient’s name and department, if applicable. Shipping to a Hospital If you are sending your package to a hospital, please verify that the hospital will receive perishable shipments. Please let the hospital know to expect a package, and that it will go to the correct room. The Chocolate Pretzel Factory LLC is not responsible if the hospital does not accept the package or if the package does not get to the correct recipient. For these addresses, please include as much information as possible, including recipient’s name, their room number and the area of the hospital where they are located. Warm Weather Shipping During warm weather; all orders will be shipped overnight, have special insulated packaging, and cold packs. Warm weather shipping will be used at our discretion to prevent any heat damage and to ensure your package arrives in the best condition possible. 3. Dispute Resolution. The parties will attempt to resolve any claim, dispute, or controversy (whether in contract, tort or otherwise) against The Chocolate Pretzel Factory LCC, its agents, employees, successors, assigns, or affiliates (collectively for purposes of this paragraph, " The Chocolate Pretzel Factory LCC ") arising out of or relating to this Agreement, The Chocolate Pretzel Factory LCC’s advertising, or any related purchase (a "Dispute") through face-to-face negotiation with persons fully authorized to resolve the Dispute or through mediation utilizing a mutually agreeable mediator, rather than through litigation.
